These terms apply to everyone who is given an account for the HighSide programs (HighSide Directional - Live, HighSide Slide Sheet, HighSide Connect and any other program on this site, together the “Programs”). By signing in or installing any of them you agree to these terms.
The Programs — including their code, design, screens, layouts, calculations, reports, documentation and the HighSide name and logo — are the property of HighSide Directional and are protected by copyright and other intellectual property law. Nothing in these terms transfers any ownership to you.
HighSide Directional grants you a personal, non-transferable, revocable licence to use the Programs for your work, through the account issued to you, for as long as that account is active.
Accounts are issued by invitation and are personal to you. Your own data in the Programs (wells, reports, settings) remains yours to use for your work. Data pulled from third-party systems (for example Pason, NOV MAX or PRIME) stays subject to those systems’ terms and your employer’s rules. HighSide Directional may suspend or close an account at any time, including for breach of these terms.
The Programs, their methods and any non-public information about them are confidential. You will not disclose them to anyone outside your organisation without HighSide Directional’s written permission.
The Programs are provided “as is”. They support, but do not replace, your professional judgement; you remain responsible for decisions made on a rig. To the fullest extent the law allows, HighSide Directional is not liable for any loss arising from use of, or inability to use, the Programs.
These terms may be updated; the current version is always at highsidedirectional.com/terms. If you do not agree to a change, stop using the Programs. On termination of your account, your licence ends and you must stop using and delete any copies of the Programs in your possession.
These terms are governed by the laws of Alberta and the federal laws of Canada applicable there, and the courts of Alberta have jurisdiction over any dispute.
